"Company" means HOLLYWOODIOWNU / Lary Gary Mods.
"You" means the individual or legal entity accepting this EULA.
"Early Access / Beta" means pre-release software provided prior to general commercial release.
"Device" means a single computer you own or control.
"Services" means any Company-hosted activation, validation, licensing, update, telemetry, or related systems.
You represent and warrant that you are at least 18 years old and legally capable of entering into a binding agreement.
Subject to your compliance with this EULA and any required activation or payment, Company grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Software on up to one (1) Device for personal or commercial streaming use, unless additional seats are granted in writing.
This license grants usage rights only. No ownership is transferred.
(a) YOU ACKNOWLEDGE THAT THE SOFTWARE IS EARLY ACCESS / BETA SOFTWARE.
(b) The Beta period may last an extended duration, including multiple years.
(c) Company makes no guarantee of general release, roadmap completion, or feature permanence.
(d) Company may modify, remove, suspend, discontinue, or materially change the Software or Services at any time, with or without notice.
(e) Any reference to "Lifetime" access means access for the operational life of the Software as determined solely by Company. It does not guarantee perpetual availability.
(f) All payments are final except where required by law or where Company provides an explicit written refund policy at time of purchase.
(g) You are responsible for applicable taxes.
(a) The Software may require license key activation, online validation, and periodic server communication.
(b) Company may modify validation systems to prevent fraud, abuse, or unauthorized sharing.
(c) Updates may be required for continued functionality.
(d) Company may block insecure, outdated, compromised, or abused versions.
(e) Temporary outages of activation or validation systems may affect availability.
(a) The Software is not guaranteed to be bug-free, stable, secure, uninterrupted, or error-free.
(b) Data loss, configuration loss, downtime, or unexpected behavior may occur.
(c) The Software may integrate with third-party platforms (e.g., Twitch, YouTube, Kick). Company is not responsible for their outages, API changes, bans, rate limits, enforcement actions, or policy decisions.
(d) You are solely responsible for backups and verifying configuration before live production use.
(a) Redistribute, resell, sublicense, rent, lease, lend, share, or publicly provide access to the Software;
(b) Reverse engineer, decompile, disassemble, modify, or create derivative works except where prohibited by law;
(c) Circumvent or tamper with license validation, DRM, access controls, rate limits, or anti-abuse systems;
(d) Remove or obscure proprietary notices;
(e) Use the Software unlawfully or to infringe third-party rights.
The Software, including all code, UI, branding, documentation, and related materials, is owned by Company and its licensors. This EULA grants a limited license only.
The Software may collect and transmit limited technical and diagnostic data including application version, activation status, hashed device identifiers, error logs, performance metrics, and IP address during license validation. By using the Software, you consent to such collection as described in the Privacy Policy.
Any feedback you provide may be used by Company without restriction or compensation.
(a) This EULA remains effective until terminated. Your license terminates automatically upon breach.
(b) Company may suspend or revoke access for fraud, abuse, chargebacks, key sharing, or material violation.
(c) Company may implement remote license deactivation mechanisms for enforcement.
(d) Upon termination, you must immediately cease use and delete all copies.
(a) COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, STREAMING INCOME, SUBSCRIBERS, PLATFORM ACCOUNT SUSPENSION, DEMONETIZATION, OR BUSINESS INTERRUPTION.
(b) COMPANY IS NOT RESPONSIBLE FOR THIRD-PARTY PLATFORM ACTIONS INCLUDING ACCOUNT BANS, API CHANGES, ENFORCEMENT ACTIONS, OR SERVICE DISRUPTIONS.
(c) COMPANY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (i) THE AMOUNT YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (ii) $50 USD.
Company shall not be liable for failure or delay resulting from causes beyond its reasonable control, including natural disasters, internet outages, infrastructure failures, cyberattacks, governmental actions, or other force majeure events.
You agree to defend, indemnify, and hold harmless Company from claims, damages, liabilities, and expenses arising from your use of the Software or your violation of this EULA.
Nothing in this EULA creates any partnership, joint venture, employment, franchise, or agency relationship. You have no authority to bind Company.
You may not use or export the Software in violation of U.S. export or sanctions laws.
(a) You agree to attempt informal resolution for 30 days before filing a claim.
(b) Disputes shall be resolved by binding arbitration under the Federal Arbitration Act in Colorado.
(c) Claims must be brought individually — not as part of a class or collective action.
(d) You may opt out of arbitration within 30 days of first acceptance by emailing Company.
This EULA is governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
Company may update this EULA; continued use requires acceptance of updated terms. If any provision is unenforceable, the remainder stays in effect. This EULA constitutes the entire agreement between you and Company regarding the Software.
